Privatizare ratată pentru Oltchim
Niciunul din investitorii care se arătaseră interesați de combinatul Oltchim nu a depus o ofertă până ieri (termenul limită), pentru preluarea acestuia.
Combinatul, care se află în insolvență de la începutul anului trecut, nu va mai fi cel mai probabil privatizat. Pe 10 martie a fost programată întâlnirea creditorilor, unde va fi votat planul de reorganizare întocmit de administratorul judiciar.
Oltchim are datorii istorice de peste 700 de milioane de euro la Electrica și Avas și a generat datorii noi în perioada de insolvență, până lunile trecute când a reușit să intre pe profit operațional, datorită deschiderii unei noi secții de producție, cea de-a rteia, care a adus capacitatea de producție la circa 30%.
În cardul procesului de insolvență combinatul a disponibilizat 1000 din cei circa 3.000 de angajati.
Atunci când combinatul a fost scos la privatizare, în proces de insolvență, statul a promis că va prelua de la Petrom rafinăria Arpechim, pe care să o vândă în sistem integrat cu Oltchim, lucru care nu s-a întâmplat.
Ieri a fost al patrulea termen de privatizare din acest an pentur combinatul de la Vâlcea, de care s-au arătat interesați în acest an un consorțiu de firme din China dar și investitori locali, cum ar fi Ștefan Vuza, patronul combinatului Chimcomplex, care a participat de altfel si la încercarea de privatizare a Oltchim din septembrie 2012.

Art. 102
(3) Daca nici un plan nu este confirmat si termenul pentru propunerea unui plan, in conditiile art.94, a expirat, judecatorul-sindic va dispune inceperea de indata a procedurii falimentului, in conditiile art.107 si urmatoarele.
(4) Remuneratiile persoanelor angajate in temeiul art.10, art.19 alin.(2), art.23, 24 si al art.98 alin.(3) si alte cheltuieli administrative vor fi achitate la momentul prevazut, dupa caz, de lege, cu exceptia cazurilor in care partile interesate ar accepta, in scris, alte termene de plata. Planul trebuie sa precizeze in programul de plati cum va fi asigurata aceasta plata.
(5) Plata va putea fi facuta trimestrial, pe baza de acte legale.

Sectiunea 7 - Falimentul
Art. 123
Creantele vor fi platite, in cazul falimentului, in urmatoarea ordine:
1. taxele, timbrele sau orice alte cheltuieli aferente procedurii instituite prin prezenta lege, inclusiv cheltuielile necesare pentru conservarea si administrarea bunurilor din averea debitorului, precum si plata remuneratiilor persoanelor angajate in conditiile art.10, art.19 alin.(2), art.23, 24 si ale art.98 alin.(3), sub rezerva celor prevazute la art.102 alin.(4);
2. creantele izvorate din raportul de munca; [ angajati si disponibilizati creante neachitate salarii si drepturi legale]
3. creantele reprezentand creditele, cu dobanzile si cheltuielile aferente, acordate de institutii de credit dupa deschiderea procedurii, precum si creantele rezultand din continuarea activitatii debitorului dupa deschiderea procedurii;
4. creantele bugetare;
5. creantele reprezentand sumele datorate de catre debitor unor terti, in baza unor obligatii de intretinere, alocatii pentru minori sau de plata a unor sume periodice destinate asigurarii mijloacelor de existenta;
6. creantele reprezentand sumele stabilite de judecatorulsindic pentru intretinerea debitorului si a familiei sale, daca acesta este persoana fizica;
7. creantele reprezentand credite bancare, cu cheltuielile si dobanzile aferente, cele rezultate din livrari de produse, prestari de servicii sau alte lucrari, precum si din chirii;
8. alte creante chirografare;
9. creantele subordonate, in urmatoarea ordine de preferinta:
a) creditele acordate persoanei juridice debitoare de catre un asociat sau actionar detinand cel putin 10% din capitalul social, respectiv din drepturile de vot in adunarea generala a asociatilor, ori, dupa caz, de catre un membru al grupului de interes economic;
b) creantele izvorand din acte cu titlu gratuit.
